Rental contract — La Balsamine gîte

General rental terms

The terms below govern the rental of the gîte. They are also available as a PDF, attached to the booking contract. This English version is provided for convenience; the French version prevails.

1 — General provisions

Under no circumstances may the tenant claim any right to remain on the premises beyond the period initially set out in this contract.

2 — Payment

The booking becomes effective once the tenant returns a signed copy of this contract together with the deposit (30% of the total amount).

The balance of the rental is paid 30 days before arrival, and the security deposit is paid 30 days before arrival.

3 — Security deposit

30 days before arrival, a security deposit is required by the owner. It is a fixed amount of €2,000. The owner is entitled to cash the security deposit.

It is returned to the tenant after the joint check-out inventory, or sent within 7 days, less, if necessary, the cost of restoring the premises and replacing the items and equipment provided. This period may not exceed 60 days.

If the deposit is insufficient, the tenant undertakes to make up the difference, on the basis of supporting documents provided by the owner.

4 — Use of the premises

The tenant shall use the rental peacefully and make good use of it, in accordance with the purpose of the premises. Parties, birthdays, hen and stag nights are prohibited in the gîte (indoors and outdoors).

On departure, the tenant undertakes to leave the accommodation as clean as it was found on arrival. The rental may in no case benefit third parties.

The owner must provide accommodation that matches the description given and keep it fit for use.

5 — Number of occupants

The number of tenants may not exceed the capacity indicated on the contract, i.e. 12 people. However, an exception may be granted by the owner. In this case, and given the additional costs incurred by the change in the number of occupants, a surcharge may be calculated on a pro-rata basis according to the number of people.

6 — Minimum number of nights

The rental period for the gîte may not be less than two consecutive nights. During school holidays, bookings of one week will be given priority.

7 — Inventory of fixtures and contents

The inventory of fixtures and of the furniture and various equipment is carried out jointly at the beginning and end of the stay by the owner and bears the signatures of both parties.

8 — Cancellation conditions

Any cancellation must be notified as soon as possible. The deposit will always be considered as a forfeit and credited against the rental price. See the cancellation conditions specific to the contract.

9 — Interruption of the stay

In the event of an early interruption of the stay by the tenant, not arising from force majeure, no refund will be made, except for the security deposit. Force majeure is recognised if the tenant can justify a serious reason making it impossible to complete the rental. In this case, the owner may refund the sums already paid, corresponding to the pro-rata share of the unused occupancy period.

10 — Insurance

The tenant is required to insure the premises entrusted or rented to them. They must check whether their main home insurance contract provides holiday-rental extension cover. If not, it is advisable that they check with their insurer.

An insurance certificate will therefore be required from the tenant before arrival.

11 — Disputes or complaints

If the complaint concerns the inventory of fixtures or the descriptive statement of the rental, it must be made in writing within seven days of arrival. The owner and the tenant must seek an amicable settlement. For other disputes, the tenant may refer the matter, without restriction, to a representative body.

Signature

Tenant’s signature: preceded by the words “read and approved” (« lu et approuvé ») when the rental contract is signed.
